Mesothelioma and Asbestos

Mesothelioma is an aggressive form of cancer that attacks the mesothelial linings in certain areas of the body. While mesothelioma is most common in the lungs (pleural) and abdomen (peritoneal), it can also occur in the heart (pericardial) and the testicles (testicular).

Asbestos exposure is the main cause of pleural mesothelioma. These fibrous minerals occur naturally in the environment, and have been mined and used commercially in North America for over a century. Its durability and heat resistant properties made asbestos an ideal material for roofing shingles, floor tiles, ceiling materials, cement compounds, textile products, automotive parts, and more. However, due to its association with mesothelioma and other diseases, the use of asbestos has been greatly curtailed since the 1970s.

As early as the 1920s, asbestos was known to be dangerous. In fact, many mesothelioma lawsuits cite a memo written in 1958 by an executive at the National Gypsum Co.: “We know that you will never lose sight of the fact that perhaps the greatest hazard in your plant is with men handling asbestos. Because just as certain as death and taxes is the fact that if you inhale asbestos dust you get asbestosis.”  Yet it wasn’t until the 1970s that government and industry finally took steps to protect workers and the public from this dangerous material.

How Can a Mesothelioma Lawyer Help?

Victims of mesothelioma deserve compensation for all of the damages related to their illness, including medical bills and lost wages. Some of the companies that used asbestos have established trust funds in order to provide restitution to their sickened workers and their families.  According to the U.S. Government Accountability Office (GAO), close to $17.5 billion has already been awarded to people suffering from mesothelioma and other asbestos-related diseases. An estimated $30-40 billion is still available for future cases.

If you’ve been hurt by asbestos, it’s important to retain an experienced mesothelioma lawyer who understands the complex issues at the center of these cases. Such an attorney will be able to determine whether or not you are eligible to access compensation from an asbestos trust. If you do pursue a mesothelioma lawsuit through the courts, an experienced lawyer will advocate for you throughout the entire process, from settlement negotiations through trial, to ensure that you are treated fairly and receive the maximum compensation possible.

You may be worried that retaining a mesothelioma attorney will be too expensive.  However, Bernstein Liebhard LLP accepts these cases on a contingency basis. In other words, you will not be required to pay any up-front legal fees or costs unless a recovery is made on your behalf. Our fees will be waived entirely if your claim is not successful.
